2. INTRODUCTION: Continental Tire North America, Inc. is offering the Take it to the MAX! Sweepstakes (the "Sweepstakes").
3. ELIGIBILITY: The Sweepstakes is open only to legal residents of the 50 United States and the District of Columbia who are 18 years of age or older as of 3/15/07 and who possess a valid driver’s license. Employees of the Sponsor (as defined below) and its parents, subsidiaries, affiliated companies, dealers and agents, and the foregoing employees’ household or immediate family members (defined as parent, spouse, child, sibling or grandparent) are NOT eligible to enter the Sweepstakes.
4. TIMING: Sweepstakes begins at 10 a.m. Eastern Time ("ET") on 3/15/07 and ends at 5 p.m. ET on 6/15/07 (The "Sweepstakes Period").
5. HOW TO ENTER: Limit one entry per person. To enter, during the Sweepstakes Period correctly complete an official entry form (available as detailed below) and transmit as directed (please note that all required information/fields on official entry form must be fully, accurately and legibly completed or entry may be voided). Official entry forms are available at ‘www.takeittothemaxtour.com. Sponsor reserves the right to include a Sweepstakes official entry form at any additional authorized website or other authorized location and to expand the methods of entry to include mailed and/or deposited entries. Sponsor may also ask optional questions on entry form; completion of these questions is not required to enter the Sweepstakes.
6. GRAND PRIZE: One (1) grand prize will be awarded consisting of: a) A used 2007 Mustang GT V8 Coupe with a total approximate retail value ("ARV") of $25,000 (value includes depreciation due to use and resulting wear and tear); b) A custom designed General Tire Gibson Les Paul Guitar with an ARV of $5,000. The grand-prize winner must personally take delivery of the above-mentioned Mustang at an award presentation event at a location (location and exact date to be determined solely by Sponsor) during either July or August, 2007 (the "Award Presentation"), or grand-prize winner may forfeit any right to the grand prize and the prize may be awarded to an alternate by random drawing. In order for the grand-prize winner to travel to the Award Presentation, the prize also includes: i) Coach class one-way airfare for the grand-prize winner only to fly from a major gateway airport closest to the said winner's U.S. residence to a major airport near the Award Presentation location (airfare may not be awarded if the winner resides within 200 miles of said location); ii) One-nights’ lodging; iii) $250 spending cash. The award of the above-mentioned airfare, lodging and spending cash is contingent upon the grand-prize winner attending the Award Presentation, and the above-mentioned spending cash will be awarded after the Award Presentation only. GRAND-PRIZE WINNER WILL ALSO BE RESPONSIBLE FOR ALL COSTS INCURRED TO DRIVE OR SHIP THE GRAND-PRIZE VEHICLE FROM THE AWARD PRESENTATION LOCATION TO THE SAID WINNER’S RESIDENCE. The total ARV of the grand prize including the above-mentioned Mustang, Guitar, airfare, lodging and spending cash is $30,700.
7. FIRST PRIZE: One (1) first prize will be awarded consisting of: a) A 3-day/2-night trip for the winner and two guests ("Guests") to attend a music performance at Blender Theater in New York City sometime between August and October, 2007 (the "Trip"). The total ARV of the Trip is $3,000; b) A custom designed General Tire Gibson Les Paul Guitar with an ARV of $5,000. The Guests for the Trip must be 18 years of age or older at the time the Travel Companion Release referred to below is executed. The Trip includes: i) Coach class, round-trip airfare for three from a major gateway airport closest to first-prize winner's U.S. residence to New York (winner and Guests must fly together) ($200 cash may be awarded in lieu of airfare if said winner resides within 250 miles of New York City); ii) Two-nights’ lodging (double or triple occupancy); iii) $250 spending cash; iv) Three VIP tickets to a music performance at Blender Theater (Sponsor will provide first-prize winner with three possible music performance options from which said winner must choose one). The first-prize winner must take the Trip by October 31, 2007 or may forfeit any right to the Trip portion of the prize, in such case the Trip portion of the first prize may not be awarded. The total ARV of the first prize including the Trip and the above-mentioned guitar is $8,000 (actual value may vary depending upon location of first-prize winner and fares/rates when booked).
8. SECOND PRIZE: One (1) second prize will be awarded consisting of a Kicker car audio system with an ARV of $2,000.
9. THIRD PRIZE: One (1) third prize will be awarded consisting of a Sony PS3 with an ARV of $800.
10. FOURTH PRIZE: Four (4) fourth prizes will be awarded each consisting of an iPod Nano with an ARV of $200 each.
11. PRIZES, GENERAL: The total ARV of all prizes to be awarded in the Sweepstakes is $42,300. Limit one prize per person. Visual prize depictions may not accurately represent an awarded prize. Each prize is nontransferable and must be accepted as awarded. No cash or other substitution may be made, except by Sponsor in the event that a prize or part thereof cannot be awarded for any reason; in such event Sponsor will in its sole discretion award a substitute prize or part thereof of equal or greater value. Subject to the conditions herein, each prize will be awarded. Each winner is solely responsible for any and all applicable federal, state, and local taxes (including where applicable sales tax) due for a Sweepstakes prize awarded to him/her, as well as all applicable fees and expenses related to the acceptance, award, and use of his/her Sweepstakes prize. This includes (but is not limited to) a winner’s sole responsibility where applicable for: vehicle registration (including any required vehicle modifications), vehicle license, title, insurance, gas, vehicle maintenance, travel insurance, personal expenses, meals, room service, telephone, gratuities, incidentals and any other expenses not specifically set forth herein as included with a prize. Sponsor is awarding each prize on an "AS-IS" basis without warranty, guaranty or representation of any kind express or implied, including without limitation any implied warranty of merchantability, fitness for a particular purpose, or where applicable legality for use in a winner’s state or compliance with emissions regulations. A winner may be required to present a valid driver’s license and satisfactory proof of insurance prior to a prize award. All details regarding the grand-prize Award Presentation trip or the first prize Trip including (but not limited to) travel dates and times, airline(s), flights, seats, hotel/motel and room(s) will be designated solely by Sponsor, and may be changed at any time at Sponsor’s sole discretion.
12. RANDOM DRAWING: On or about 6/20/07 winners will be selected by random drawing from all eligible entries received. The above-mentioned drawing will be conducted by an independent judging organization, whose decisions along with those of the Sponsor on all matters related to the Sweepstakes shall be final and binding. A participant selected as a potential winner must comply with all terms and conditions set forth in these official rules, and winning is contingent upon fulfilling all such requirements. Odds of winning depend on the total number of eligible entries received.
13. NOTIFICATION: Potential winners will be notified (the "Notification") by mail (or other method at the discretion of Sponsor) within about three days after the above-mentioned random drawing, and will be provided with a telephone number that a potential winner must call within 48 hours of receipt of the Notification to confirm eligibility and where applicable availability for any trip included with a prize. In addition, within seven (7) days of the postmark of the Notification, a potential winner must return ("Return") via overnight delivery as directed (first-class mail may be used for a second, third or fourth prize) each of the below-listed applicable documents as determined by Sponsor: a) An Affidavit, Waiver, Release and Indemnity Agreement, including where lawful a Publicity Release (prior to Return, to be correctly completed and executed by a potential winner); b) A Travel Companion Release, including where lawful a Publicity Release (prior to Return, to be correctly completed and executed by a Guest who will accompany a winner on a herein described prize trip). Please note that additional documents may be required at the discretion of Sponsor. If the initial Notification is sent to a potential winner via email, an email reply from such potential winner must be received by the sender of the initial email within five days of such potential winner’s receipt of initial email (thereafter, such potential winner will be sent the applicable above-mentioned document(s) and the Return reply deadline will apply). Failure to comply with the requirements of this paragraph (or the return of a prize or prize notification as non-deliverable) may result in disqualification and in the forfeiture of any right to the prize, in which case such prize will be awarded to an alternate by random drawing.
14. E-MAIL ADDRESS: In the event of a dispute regarding which individual submitted any entry, such entry will be deemed submitted by the natural person whose name is on the submitted entry form (and proof thereof may be required of a winner).
15. RELEASE: By participating in the Sweepstakes and/or accepting a prize, a participant/winner agrees to defend, release and hold harmless the Sponsor, Gibson Guitar Corporation, Stillwater Designs and Audio, Inc. and their respective parents, subsidiaries, affiliates, divisions, advertising and promotion agencies, and the foregoing companies’ officers, directors, shareholders, employees, representatives, agents and all others associated with the development and execution of the Sweepstakes (collectively the "Releasees") from and against any actions, claims and/or liability for injury, loss or damage of any kind (including any for the violation or infringement of any proprietary or personal right of any individual or entity) resulting in whole or in part, directly or indirectly, from participation in the Sweepstakes, and/or the use, acceptance, or possession of a Sweepstakes prize, and/or participation in a Sweepstakes prize-related activity. By participating in the Sweepstakes and/or accepting a prize, a participant/winner consents to and gives the Sponsor the right to use a participant’s/winner’s name, address and entry form information, to photograph/video a winner and a winner’s property, and in perpetuity to use a winner’s statements, quotes, picture, portrait, likeness, voice, video, biographical information, prize information, and winner-submitted photograph(s)/text (in whole or in part, as may be adapted, edited or modified, as solely determined by Sponsor) for advertising, trade, publicity and promotional purposes in any media now known or hereafter discovered, worldwide, and on the World Wide Web, without review, notification or approval, all without additional consideration, unless prohibited by law. Entries will not be acknowledged or returned.
16. CONDITIONS: Participants agree that by participating in the Sweepstakes they release the Releasees from any liability in connection with: a) Entries that are ineligible as a result of being lost, late, illegible, damaged, incomplete, stolen, postage due, or misdirected; b) Any typographical or other human or technical errors in the offer or administration of the Sweepstakes, including but not limited to errors in advertising, these official rules, the selection and announcement of a winner(s), or the distribution/awarding of a prize(s); c) Any omission, interruption, deletion, defect, delay, misdirection, damage, line failure, injury, technical malfunctions or traffic congestion on the Internet/telephone network, or at any website, or any combination thereof. Sponsor reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Sweepstakes. In the event that the Sweepstakes is infected by a computer virus/worm, or is not capable of running or being executed as planned (as a result of but not limited to an error, omission, defect, delay, misdirection, tampering, unauthorized intervention, fraud, action of entrants, or technical failure) or any other cause which in the sole opinion of Sponsor corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Sponsor reserves the right in its sole discretion to disqualify any suspect entry or entrant and to cancel, terminate, modify or suspend the Sweepstakes. In the event of such cancellation, termination, modification or suspension, notice thereof will be posted at the entry website mentioned above, and winner(s) will be determined solely by the Sponsor or an independent judging organization in a random drawing from among all eligible non-suspect and/or non-disqualified entries. In such event, Releasees shall have no liability to any participant who is disqualified due to such an action. Failure to enforce any term of these official rules shall not constitute a waiver of that provision.
17. LAWS: Subject to all federal, state and local laws and regulations. Void where prohibited or restricted.
18. WINNERS’ LIST: A winners’ list will be available by sending an SASE by 7/31/07 to: Take it to the MAX! Sweepstakes, Winners’ List, P.O. Box 459, Dana Point, CA 92629-0459.
